The rules that apply when you visit phoenixballet.org or use services made available through the website.

These Terms of Use (the “Terms”) apply to phoenixballet.org and the website services offered by Phoenix Ballet (“Phoenix Ballet,” “we,” “us,” or “our”). By using the website, you agree to these Terms. If you do not agree, please do not use the website.
Our Privacy & Cookies notice explains how the website handles information and browser storage.
You may use this website for lawful, personal, and noncommercial purposes. You may not interfere with the website, attempt to gain unauthorized access to its systems, introduce malicious code, use automated means in a way that burdens the website, or use its content to violate another person’s rights.
If you are not legally able to enter into a contract, a parent or legal guardian must authorize purchases or other transactions made for you.
The website and its text, photographs, video, audio, graphics, logos, designs, and other content are owned by Phoenix Ballet or used with permission and are protected by intellectual-property laws. Except as the law permits, you may not copy, reproduce, publish, distribute, modify, publicly perform or display, sell, license, or commercially exploit that content without written permission from the applicable rights holder.
You may share links to public pages as long as you do not suggest an endorsement or affiliation that does not exist.
Performance dates, times, venues, programs, casting, artists, pricing, and availability may change. Ticket purchases may be processed by venues or third-party ticketing services such as Etix or Ticketmaster. Their purchase terms, fees, refund rules, privacy practices, and venue policies may also apply.
Review the terms shown by the official ticket seller before purchasing. Questions about a ticket purchase should be directed first to the seller identified in the confirmation, unless Phoenix Ballet states otherwise.
Phoenix Ballet’s streaming library is provided with VideoApps and may offer individual rentals, subscriptions, and live pay-per-view access. The price, access period, renewal terms, technical requirements, and cancellation instructions shown when you purchase are part of these Terms. If transaction-specific terms conflict with this page, the transaction-specific terms control for that purchase.
Subscriptions continue and renew automatically until canceled. Review the renewal and cancellation terms before submitting payment and see our Streaming Policies for current support information. You are responsible for keeping account credentials secure. Sharing passwords or attempting to bypass access controls is prohibited.
Except where required by law or stated otherwise during purchase, streaming sales are final. Streaming availability and quality may depend on compatible devices, internet service, and third-party systems outside Phoenix Ballet’s control.
Online donations are processed through Donorbox or another identified payment provider. Provider terms and privacy practices may apply. Donations are voluntary and generally nonrefundable, except where required by law or when Phoenix Ballet agrees to correct a processing error.
Phoenix Ballet is a 501(c)(3) nonprofit organization. The tax treatment of a contribution depends on individual circumstances. Donors should retain their receipt and consult a qualified tax adviser with questions.
When you send a message, request information, subscribe to updates, or otherwise submit information through the website, you confirm that the information is accurate and that you have the right to provide it. Do not submit confidential, unlawful, infringing, or harmful material. We may use your submission to respond to you, provide the requested service, protect the website, and operate Phoenix Ballet as described in our Privacy & Cookies notice.
The website links to or embeds services operated by others, including ticketing, streaming, payment, donation, mapping, and social-media providers. Phoenix Ballet does not control those services and is not responsible for their content, availability, security, or practices. A link or embed does not by itself mean that Phoenix Ballet endorses every product, statement, or policy of the provider.
We work to keep the website accurate and available, but the website and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Phoenix Ballet disclaims warranties that are not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not guarantee that the website will always be uninterrupted, error-free, secure, or current.
To the fullest extent permitted by law, Phoenix Ballet and its directors, officers, employees, artists, contractors, and volunteers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, the website or a third-party service. Nothing in these Terms excludes liability that cannot legally be excluded or limited.
We may change, suspend, or discontinue any part of the website and may update these Terms from time to time. The effective date above identifies the current version. Changes apply after the updated Terms are posted and do not retroactively change transaction terms already agreed to unless the law permits and appropriate notice is provided.
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute relating to these Terms or the website must be brought in a state or federal court with jurisdiction in Maricopa County, Arizona, unless applicable law requires otherwise.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
